Not everyone connected to a negligent act is automatically liable for damages. In negligence law, liability isn’t imposed simply because someone was present or associated with the event. A party must have a duty to the harmed person, breach that duty, and have that breach cause damages. Additional liability rules can apply, such as vicarious liability where an employer can be responsible for an employee’s negligence, or joint liability among those who contributed to the harm. But being merely linked to the incident or to the negligent party does not by itself make someone legally responsible. Context matters: the relationship to the case, the degree of involvement, and whether the necessary elements—duty, breach, causation, and damages—are present determine who can be held liable.
